408 permission, request to alter Corps projects: I-35W bridge replacement

Interested parties are hereby notified that a request for permission to alter a U.S. Army Corps of Engineers project has been received and will be evaluated by the Saint Paul District. The request will be evaluated by the Corps under the authority of Section 14 of the Rivers and Harbors Act of 1899 (33 U.S.C. Section 408). Written comments are being solicited from anyone having an interest in the requested alteration. Comments will become part of the Corps' administrative record and will be considered in the decision on the request. Comments supporting, opposing, or identifying concerns that should be considered by the Corps in its decision process are all welcome. Comments providing substantive information or a rationale for the commenter’s position are the most helpful.

REQUESTED ALTERATION:

Minnesota Department of Transportation has requested Section 408 permission for certain work affecting the Minnesota River 9-Foot Navigation Channel Project associated with the "I-35W Over the Minnesota River Bridge Project." Overall, the I-35W bridge project would replace the existing I-35W Minnesota River bridge, reconstruct approximately two miles of I-35W adjacent to the Minnesota River bridge, and replace the I-35W bridges over West 106th Street. General information concerning the overall project can be found on the Minnesota Department of Transportation’s website at https://www.dot.state.mn.us/metro/projects/i35wbloomington/. Subject to the Section 408 permission, the Minnesota Department of Transportation is requesting approval to alter the federal project by constructing a new northbound bridge east of the existing bridge, replacing the existing bridge and placing barges near the existing bridge piers to facilitate in their removal. Plans showing the proposed alterations to the federal project are attached to this notice. The Minnesota River 9-Foot Navigation Channel Project at the location of the proposed alterations consists of a 9 foot navigation channel approximately 100 feet in width. Work occurring outside the limits of the federal project are not within the scope of the Section 408 review, but may require authorization or review and other federal, state, and local agencies. The proposed alterations are not expected to impair the usefulness or resiliency of the federal project.

PERMISSION AUTHORITY: The authority to grant permission for temporary or permanent use, occupation or alteration of any Corps of Engineers civil works project is contained in Section 14 of the Rivers and Harbors Act of 1899, as amended, codified at 33 USC 408 ("Section 408"). Section 408 authorizes the Secretary of the Army to grant permission for the alteration or occupation or use of a USACE project if the Secretary determines that the activity will not be injurious to the public interest and will not impair the usefulness of the project.
