2020-00260 U.S. Army Corps of Engineers Issues Validated Permit to Enbridge Energy for Line 5 Wisconsin Segment Relocation

Notice:

The United States Army Corps of Engineers (USACE) St. Paul District has issued a validated permit to Enbridge Energy to cross the White River, permanently discharge fill material into 998 square feet of wetlands, and temporarily discharge dredged and fill materials into 101.1 acres of wetlands and 0.20 acres of non-wetland waters for the construction of the Line 5 Wisconsin segment relocation. The project is located in parts of Bayfield, Ashland and Iron Counties, Wisconsin.

The USACE has determined that issuance of the permit complies with all applicable federal laws and regulations. This includes the National Environmental Policy Act, Section 404 of the Clean Water Act, Section 10 of the Rivers and Harbors Act, Section 7 of the Endangered Species Act, and Section 106 of the National Historic Preservation Act. Issuance of the permit is also compliant with federal Tribal Trust responsibilities and is within the public interest.

Background:

The Line 5 Wisconsin segment relocation was proposed to move the existing Line 5 pipeline outside the Bad River Band of Lake Superior Chippewa (Bad River) Reservation. The project would replace 20 miles of the existing Line 5 pipeline, including 12 miles of pipeline within the Bad River Reservation, with 41 miles of new pipe located entirely outside the boundaries of the Bad River Reservation. USACE does not regulate the overall construction or operation of pipelines, nor does it regulate the siting of any type of pipeline, or any substance being transported within a pipeline.
