PUBLIC NOTICE – 2019-0009

Interested parties are hereby notified that a request for permission to alter a U.S. Army Corps of Engineers (Corps) project has been received and will be evaluated by the St. Paul District. The request will be evaluated by the Corps under the authority of Section 14 of the Rivers and Harbors Act of 1899 (33 USC Section 408).  Written comments are being solicited from anyone having an interest in the requested alteration. The comment period closes at the date listed below. Comments will become part of the Corps’ administrative record and will be considered in the decision on the request. Comments supporting, opposing, or identifying concerns that should be considered by the Corps in its decisions process are all welcome. Comments providing substantive information or a rationale for the commenter’s position are the most helpful.

REQUESTED ALTERATION: To modify the Flood Control Project on the Red River of the North at Argusville, North Dakota; specifically to direct bury a new fiber optic cable over top of the levee in three separate locations

PERMISSION AUTHORITY: The authority to grant permission for temporary or permanent use, occupation, or alteration of any Corps of Engineers civil works project is contained in Section 14 of the River and Harbors Act of 1988, as amended, codified at 33 USC 408 (“Section 408”). Section 408 authorizes the Secretary of the Army to grant permission for the alteration or occupation or use of a USACE project if the Secretary determines that the activity will not be injurious to the public interest and will not impair the usefulness of the project.
