About Our Regulatory & Permits Office

The mission of the Corps of Engineers' Regulatory Program is to protect the nation's aquatic resources, while allowing reasonable development through fair, flexible and balanced permit decisions. The Corps evaluates permit applications for essentially all construction activities that occur in the nation's waters, including wetlands.

The Corps' regulatory program includes Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act. The St. Paul District's regulatory jurisdiction covers the states of Minnesota and Wisconsin.

Under Section 10, a Corps permit is required to do any work in, over or under a 'Navigable Water of the U.S.' Waterbodies have been designated as 'Navigable Waters of the U.S.' based on their past, present or potential use for transportation for interstate commerce.

Under Section 404, a Corps permit is required for the discharge of dredged or fill material into waters of the U.S. Many waterbodies and wetlands in the nation are waters of the U.S. and are subject to the Corps' Section 404 regulatory authority.

2005-04889-MMJ (Yellow Medicine County, MN) Martin Marietta Quarry Progression Project
LETTER OF PERMISSION: The Applicant is proposing to continue an existing quarry pit progression in the southwestern portion of the project site, up to the top of cut quarry extent boundary. The proposed project would involve excavation activities resulting in the discharge of dredged material into 1.35 acres of wet meadow and shallow marsh type wetland (Public Water Basin 87-45W).

PUBLIC NOTICE: The sponsor is proposing to develop the 5L Farms Wetland Bank. The proposed bank site is approximately 118 acres in size, including upland buffer areas.

2015-02528-MMW (Lake County, MN) Northshore Mining Company Project
PUBLIC NOTICE: Northshore Mining Company (NSM) is requesting a Department of the Army permit for the proposed discharge fill material into 272.16 acres of wetlands, 35.96 acres of Murphy’s Pond, and 2.53 acres (7,737 linear feet) of stream for the purpose of the Milepost 7 Tailings Basin progression of 845 acres in conjunction with the relocation of the existing railroad serving as the northwest embankment of the basin approximately 4,000 linear feet to the northwest.
